Date and Time of Hearing: April 7, 1999, 10:00 A.M. To Owners, Lessees and other persons with a recorded interest: Pursuant to Chapter 2 of the San Francisco Building Code, the above referenced property has failed to comply with the PARAPET SAFETY PROGRAM REQUIREMENTS. San Francisco Building Code Section 212 requires an engineer or architect to investigate the parapets on your building and submit a written report on their condition to the Department of Building Inspection. Failure to complete this report is a violation of the Building Code. Once a violation of the building code is found, the Department of Building Inspection is authorized to conduct administrative hearings to compel abatement of the violation. In this instance, at the Director's Hearing, an order of abatement determining that the building is a public nuisance as a result of failure to submit a report will be issued and recorded against title. You can avoid this hearing by submitting a completed report before this hearing takes place. Should you fail to appear at the hearing on the above date or fail to comply with the decision of the Director, the Permit of Occupancy and/or Certificate of Occupancy for the property may be revoked. If an Order of Abatement is issued by the Director, you will be charged all administrative costs incurred by the Department in enforcing your obligation to submit a completed report. Also, if the building is residential rental property, six months from the date of the Director's hearing, the Department will notify the Franchise Tax Board, and you will be prohibited from deducting depreciation, interest, and taxes of this property from your income taxes. Finally, should the Department refer your case to the City Attorney for prosecution, civil penalties in the amount of $500.000 a day will accrue for each day a completed report is not submitted. These will be collected from you in a civil lawsuit brought against you by the City.
